Terms of Service

By accessing or using the Fytrano platform, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the Fytrano platform.

We may modify these Terms at any time, and such modifications shall be effective immediately upon posting the modified Terms on the Fytrano platform. Your continued use of the Fytrano platform following the posting of modified Terms constitutes your acceptance of those modifications.

Fytrano provides a lead generation and advertising platform that helps businesses find and connect with potential customers through targeted advertising across multiple channels. Our services include:

• Lead generation and targeting
• Advertising campaign management
• Analytics and reporting
• Lead qualification and management

Fytrano reserves the right to modify, suspend, or discontinue any aspect of its services at any time without notice or liability.

To access certain features of the Fytrano platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account.

You agree to notify Fytrano immediately of any unauthorized use of your account or any other breach of security. Fytrano will not be liable for any loss or damage arising from your failure to comply with this section.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Fytrano charges fees for its services based on the pricing plan you select. The fees are based on a per-lead pricing model, with rates varying depending on the advertising channel used:

• Facebook: $40 per qualified lead
• Google: $50 per qualified lead
• LinkedIn: $60 per qualified lead

A "qualified lead" is defined as a potential customer who has explicitly shown interest in your product or service by responding to your ad or outreach.

You agree to pay all fees associated with your use of the Fytrano platform. All fees are non-refundable unless otherwise specified. Fytrano reserves the right to change its fees at any time upon notice to you.

You retain all rights to any content you submit, post, or display on or through the Fytrano platform ("User Content"). By submitting, posting, or displaying User Content on or through the Fytrano platform, you grant Fytrano a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.

You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit. You also represent and warrant that your User Content does not violate any third-party rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws, regulations, or third-party rights
• Using the Fytrano platform for any illegal or unauthorized purpose
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Fytrano platform
• Uploading or transmitting viruses, malware, or other malicious code
• Collecting or harvesting any personally identifiable information from the Fytrano platform
• Impersonating another person or otherwise misrepresenting your affiliation with a person or entity
• Using the Fytrano platform to send unsolicited communications, promotions, or advertisements

The Fytrano platform and its original content, features, and functionality are owned by Fytrano and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Fytrano platform, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your Web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the Fytrano platform for your own personal, non-commercial use and not for further reproduction, publication, or distribution

THE FYTRANO PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, FYTRANO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FYTRANO DOES NOT WARRANT THAT THE FYTRANO PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE FYTRANO PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL FYTRANO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE FYTRANO PLATFORM, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE FYTRANO PLATFORM, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE FYTRANO PLATFORM BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE FYTRANO PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FYTRANO IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless Fytrano, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Fytrano platform; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Fytrano platform.

These Terms shall be governed and construed in accordance with the laws of the United States of America and the State of North Carolina, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Fytrano platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Fytrano platform.
